Trial by media and the quality of justice

At the CBA’s Canadian Legal Conference last month, Policy Options Editor-in-Chief Jennifer Ditchburn moderated a fascinating discussion with Senator Mike Duffy’s lawyer, Don Bayne, and Crown counsel Jocelyn Speyer about the challenges they faced litigating high-profile cases in the court of public opinion. Much of the conversation focused on media treatment of those cases.  Bayne warned that in an environment where everyone on social media has an opinion and where journalists do not always grasp the complexities of the law, there is a threat to the rule of law.  CBA National caught up with Bayne after the session to ask him about the impact this is all having on the quality of justice delivered in the courtroom.
